Case brought by William Marbury, against James Madison, to ask the Supreme Court to enforce the law set forth by the Judiciary act, passed by Congress in 1789

The Supreme Court ruled that Marbury's commission was valid, but refused to use the powers of the Judiciary Act to make Madison deliver the papers.
Additionally,
this marked the first time that the Supreme Court had determined that a law passed by Congress was unconstitutional.

Judges appointed by John Adams at the end of his presidency, many were appointed the night before Thomas Jefferson took office

midnight judges were seen as a way for the Federalists to continue playing a
large role in the government even though Jefferson, a Democratic-Republican
was near taking office.
Jefferson challenged the appointments by instructing James Madison to withhold
the appoints.
